Fatal car accidentAnother fatality due to a driver crossing a grassy median and striking oncoming interstate traffic occurred on October 8 just before 5:30 a.m. In Stafford County,  on I95, a southbound 20-year old Hampton man crossed the median and was struck by a northbound driver who in turn hit another two vehicles.  The 20-year old female passenger in the Hampton man’s car died at the scene as a result.  The Hampton driver was taken to a local hospital, treated for non-life threatening injuries, released, and then charged with reckless driving. Other drivers involved were either not injured or treated and released as well.  With such a wide median, you have to wonder how this could occur. Further investigation will no doubt follow.

The family members of the deceased New York woman may have a legal claim against the negligent driver to compensate them in a wrongful death suit.  They may be able to recover damages for sorrow, mental anguish, and solace, medical and funeral expenses, loss of income, and potentially punitive damages.  When faced with such a loss you need an experienced personal injury attorney to discuss your claim in seeking a fair settlement or taking the matter to trial if necessary.  Determining what is a fair amount for recovery can be a complex process. Before you enter into any negotiations, you should contact an experienced personal injury attorney who can help you build a strong and persuasive case using their experience to skillfully negotiate with the insurance company to receive the full compensation your case deserves or file a lawsuit to obtain a judgment against the negligent party.
