For most people, facing tough times seems inevitable. At some point in one’s life, issues with finances stemming from a lost job or bill collectors may arise, leading some to struggle to pay child support as ordered by the Family Law Court. What one should remember when facing this situation is that just because they lost their job or are facing tough financial times doesn’t mean they’re off the hook for child support. The order stands until it is adjusted or modified, typically on a temporary basis until the supporting party is able to get back on his or her feet and continue with the ordered payments.

The first thing to do upon losing one’s job is to seek a modification. Even if the other parent has agreed to a modification of support, it is still necessary to go before a judge to make the adjustment. If a modification cannot be agreed upon, which is not uncommon, a hearing in front of a judge may be necessary in which both sides may present arguments as to whether the order should be modified or not.

If one of the parent’s situation changes permanently, such as if changes are made to child support laws or if one parent becomes permanently disabled, then the order may be permanently modified. On a bit of a side note, if one parent gets remarried, the order may be modified as well, but may increase the supporting party’s monthly payments.

Upon losing one’s job, it is vital to remember to seek a modification right away. The purpose of child support is to ensure that the child is supported to the potential of both parents and the court will always act in the best interests of the child. Do not come to an informal agreement with the other parent, as disagreements between the parents may lead the other to demand full payment as well as any back support with the courts.
